1. Introduction
1.1 These terms and conditions apply to your registration to and/or use of Zipp Mobility Limited’s scooter sharing scheme. Zipp Mobility Limited is a company registered in Ireland. Our company registration number is 661055 and our registered office is at NovaUCD, University College Dublin, Belfield, Dublin 4.

If we have to contact you we will communicate through the App or by email.

2. Terms With Defined Meanings
2.1 App: means the Zipp Mobility app downloadable from the App Store and the Play Store.
Scooter or eScooter: means an electric scooter made available for hire by Zipp Mobility.
Charges: mean the charges payable by you in respect of eScooter hire and any additional charges that may be payable.
Registered User: refers to a person who has registered to use the Zipp Mobility service by providing us with certain personal and payment details when registering for an account with us.
We, our and us: refers to Zipp Mobility.
You, your: refers to a user of the Zipp Mobility service.

3. Zipp Mobility Terms
3.1 These are the terms and conditions on which we offer eScooter share and related products, services and digital content.
3.2 We reserve the right to refuse Zipp Mobility membership at our complete discretion.
3.3 You must be 16 or over to use our service.
3.4 You agree that we will process all personal data in accordance with our Privacy Policy which you can read at www.zippmobility.com/privacy-policy.
3.5 We have the right to suspend your account at any time for non-compliance with these terms.
3.6 We may amend these terms and conditions, our charges and details of the Zipp Mobility service from time to time.
3.7 We offer no guarantee that an eScooter will be available when needed. All eScooter hire is subject to availability.

4. Hiring And Returning eScooters
4.1 You may unlock an eScooter by scanning the QR code on the unit’s handlebar.
4.2 When you have finished riding the eScooter, you must park it responsibly and in accordance with local guidelines, outlined in the app.

5. eScooter Usage Charges
5.1 You will be charged a £1.00 unlock fee and £0.15 for each minute of the ride.
5.2 You need to provide a valid debit or credit card. This can be either a VISA, Visa Electron, Mastercard or Amex from which we can deduct the Charges.
5.3 By default, the payment flow will be wallet based. If you have an amount in your wallet, greater than the Minimum balance your ride will begin and the ride amount will be deducted from the wallet on conclusion of the ride. If the ride amount is more than the wallet balance, the remaining balance is deducted directly from your card.
5.4 If you have an amount less than the minimum balance, you will be given the following options –
1. Pay using a wallet – you will have to top up the wallet and add the Minimum balance to start the ride.
2. Pay using card – ride amount will be deducted from the card on conclusion of the ride.
5.5 During the period of you being a registered user, you agree not to cancel your payment card without first telling us and providing an alternative payment card from which we can collect the Charges.

6. Scooter Faults
6.1 We request you inspect the eScooter before unlocking it. Also, if you discover any problems with eScooter, we ask you to report it in the customer service section of the app or email service.zippmobility@gmail.com.
6.2 If you find a fault with the eScooter while riding, please immediately bring the eScooter to a stop and park it responsibly. Please report this fault to us on the app. Do not attempt to ride a faulty eScooter.

7. User Obligations
7.1 You are responsible for keeping the eScooter safe at all times whilst it is in your possession or control.
7.2 You agree to use the eScooter safely and responsibly and in accordance with applicable laws and regulations including the Rules of the road.
7.3 You shall comply with all Zipp Mobility policies when using our eScooters.
7.5 You must conclude your ride with the eScooter in the same condition as when you unlocked it.

8. eScooter Usage Restrictions
8.1 Only one person, the registered user, is allowed to ride the eScooter.
8.2 Do not damage, tamper, modify or make any other additions to the eScooter;
8.3 Do not park the eScooter anywhere other than in accordance with local council guidelines and Zipp Mobility’s instructions;
8.4 Do not load the eScooter with a total weight of more than 100kg or 220lbs;
8.5 Do not carry any illegal or dangerous objects;
8.6 Do not use the eScooter in a reckless or dangerous manner or to carry out any illegal activity;

9. Insurance
9.1 Our insurance partner is Zego. When riding a Zipp Mobility eScooter, you are covered under Rider Liability Insurance. This is for protection against damages to third parties. You are covered up to £1 million for material damages and unlimited for Bodily Injury to a third party.
9.2 You are also covered under Personal Accidents Insurance. This is for protection in case of injury to the body, mind or emotions. You are protected in the case of: accidental death, permanent disability, temporary total disability and repatriation due to accidents, up to a total of £50,000.

9.3 Liability to third parties: insurance claim will not be covered where;

a. The accident occurs whilst the vehicle is being used: by anyone other than you or a user, for anything other than the purposes specifically noted on the certificate of motor insurance and under your cover above or, outside of territories.

b. You to the user has another insurance policy in place which covers the same or similar risks.

c. loss or damage to the vehicle itself.

d. The loss or damage is otherwise to property which belongs to you or any user, or is in the care, custody or control of anyone insured under this policy.

e. Any bodily injury to or damage to property owned by a third party which does not occur as the direct result of an accident involving a vehicle.

f. The loss or damage claimed relates to any fines and penalties (whether civil or criminal).

g. The loss or damage relates to the costs or expenses of defending criminal proceedings where the user either: was under the influence of drink or drugs at the time of the accident; or is charged with leaving the scene of the accident or costs or expenses relating to the defence of criminal proceedings.

h. The user or any passenger is acting in he course of their employment and any liability arising from an accident is more specifically covered by an insurance required by the Employer’s Liability (Compulsory Insurance.

9.4 Personal Accident -TBU

10. Other Charges
10.1 If you damage an eScooter we will charge you a repair fee, payable on demand, of up to a maximum the value of the scooter.
10.2 If you lose an eScooter you will immediately foot the cost of the eScooter.
10.3 If you fail to park a Zipp Mobility eScooter responsibly, we may issue charges to your account.
10.4 You hereby authorise us to deduct such payments from the payment card registered to your Zipp Mobility account.

11. Further Information
11.1 Only you and we have rights under these terms and conditions. No other person shall have any rights under these terms and conditions.
11.2 You may not transfer any of your rights under these terms and conditions to any other person.
